Some Of The Government Requirements For Both You And Your Spouse

  • You are a U.S. citizen or a Resident

    You can be a native born or naturalized U.S. citizen, or a Resident but you must be one of these when you file your petition.

  • Your Spouse Entered The United States Legally

    The general rule is that your spouse needed to enter the United States legally, even if they overstayed their visa.  There are exceptions to this rule.

  • You and your spouse are lawfully married

    Your marriage has to be lawful for the state you live in, and it cannot be primarily for immigration benefits.

  • Neither you or your spouse have had serious problems with the law

    Certain violations of law can make someone ineligible to get a “green card”.  Also previously having been found to have participated in marriage fraud can keep you from petitioning your spouse.

    If your petition or application is denied, you have to start all over, and your spouse could be ordered deported. 

  • Money

    If your petition or application is denied you will have to pay all of the application fees again.  Between that and losing the time, this could cost you a lot with filing fees and lost income.
